(a) You acknowledge that Analogue Digital Pty Ltd may or may not pre-screen Content, and that there is no obligation on Analogue Digital Pty Ltd to pre-screen Content, and that Analogue Digital Pty Ltd shall have the right (but not the obligation) in its sole discretion to pre-screen, refuse or remove any Content provided by you.(b) Without limiting paragraph (a), you agree that Analogue Digital may edit, remove or not publish any Content if it considers that:(i) the Content is unlawful in any way, including because it is defamatory or breaches laws about unlawful discrimination, racial vilification, privacy or contempt;(ii) the Content is false or misleading;(iii) publication of the Content will infringe intellectual property rights (including copyright) or a person’s moral rights;(iv) the Content is abusive, offensive or obscene; or(v) the Content is otherwise in breach of these Terms and Conditions.(c) Although we may from time to time monitor or review Content, discussions, chats, postings or other contributions to the Site(s), we are under no obligation to do so and we assume no responsibility or liability arising from the contents of any such communications nor for any error, defamation, libel, obscenity, profanity or inaccuracy contained in any such communication.

Indemnity

You agree to indemnify and hold Analogue Digital Pty Ltd and its subsidiaries, affiliates, officers, agents, employees, partners and licensors harmless from any claim against us arising out of Content you submit, post, transmit or otherwise make available through the Site(s), your use of the Site(s), your connection to the Site(s), your breach of these Terms and Conditions, or your violation of any rights of another, including all damages, losses, and expenses of any kind (including reasonable legal fees and costs) related to such a claim.

Risk of loss

All items purchased from the Site(s) are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

Terms & Conditions

Each Orb Award is designed to celebrate creatives and companies who can clearly demonstrate their ability to deliver originality in their work, responsibility in the running of their business/careers and balance in the forces of working hard and working smart.

Areas which are judged include: company culture, working conditions, employee turnover, professional development, financial performance and company ethics.

Each application consists of over 50 questions, contribute to an overall Orb score.

While some questions require a basic yes/no answer, other complex questions will see your answers compared to all other entries to determine their Orb score.

The five entries per category with the highest total Orb score will qualify as finalists. All finalists will then be reviewed by an international panel of judges to determine the overall winner.

Each award will be judged blindly with all names and key identifying information hidden from judges. All Employees and affiliated designers with Analogue Digital Pty Ltd are not permitted to enter.

To validate the information provided, an interview may be required to finalise your Orb Score and determine if you make the shortlist, become a finalist, or are the winner. The Orb Award scores for shortlisted entries will be made available in the week following associated TDC Event.

Evalato is fully PCI DSS compliant, integrating with 3rd party payment gateways for credit card payment processing. Evalato don’t store any credit card details, raw magnetic stripe, card validation code, or PIN block data – that information is just passed from the person making the payment directly to the payment gateway for processing. The payment gateways we’ve integrated are certified Level 1 PCI DSS compliant service providers.

Each entry is securely stored by Digital Ocean, Inc. DigitalOcean is certified in the international ISO/IEC 27001:2013 data protection requirements, as well as fully PCI DSS compliant. The servers have SOC 2 Type II reporting, a global standard for data privacy and security, and are monitored 24/7/365 to prevent unauthorized access.

To ensure maximum protection of data, Evalato support staff do not have access to the data, nor direct access to the NAS/SAN storage systems where snapshots and backup images reside.
